1) Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms of Use (“Terms”), our Privacy Policy, and any additional policies referenced herein. If you do not agree, do not use the Service.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

3) Account Registration & Security

You are responsible for (a) providing accurate account information, (b) maintaining the confidentiality of your login credentials, and (c) all activity under your account. Notify us immediately of any unauthorized use at [email protected].

4) License & Access

Subject to these Terms and timely payment of fees, Practice Built grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own business purposes. You may not: (i) copy, modify, or create derivative works of the Service; (ii) decompile, reverse engineer, or attempt to gain unauthorized access to the Service; (iii) remove any copyright or proprietary notices; (iv) resell, sublicense, or “mirror” the Service; or (v) use the Service to violate any law or third-party rights. We may suspend or terminate access for violations of these Terms.

5) Content & Acceptable Use

You are solely responsible for content you upload or transmit (text, images, videos, claims, emails, SMS, etc.) (“User Content”). You represent and warrant that you have rights to your User Content and that it does not: infringe intellectual property, privacy, or publicity rights; contain malware or harmful code; include false, misleading, or unlawful claims; or constitute spam, harassment, or abusive material. You grant Practice Built a worldwide, non-exclusive, royalty-free license to host, display, process, and transmit User Content solely to operate the Service and support your account.

6) Intellectual Property

The Service, including software, templates, workflows, designs, and documentation, is owned by Practice Built or its licensors and protected by intellectual property laws. Except for the limited license in Section 4, no rights are granted. All trademarks, service marks, and logos are the property of their respective owners.

7) Third-Party Services

The Service may integrate with third-party products (e.g., payment processors, email/SMS gateways, scheduling tools). Your use of third-party services is governed by those providers’ terms and privacy policies. Practice Built is not responsible for third-party services.

8) Fees, Billing & Taxes

You agree to pay all fees for your selected plan and add-ons, plus applicable taxes. Subscriptions renew automatically each billing period until canceled. You authorize us (or our processor) to charge your payment method on a recurring basis. Late or failed payments may result in suspension.

Refund Policy: We offer a 15-day money-back guarantee from your initial purchase date on first-time subscriptions, provided you have not exported assets or launched live campaigns. After 15 days, all fees are non-refundable.

9) Data, Privacy & Messaging Compliance

You must obtain legally required consents from your contacts/clients for communications (email, SMS, voice drops, etc.). You agree to comply with CAN-SPAM, TCPA, CASL, GDPR/UK GDPR, CCPA/CPRA, and carrier policies. See our Privacy Policy for how we collect, process, and protect personal data.

10) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” PRACTICE BUILT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT RESULTS WILL MEET YOUR REQUIREMENTS.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRACTICE BUILT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, OR DATA; BUSINESS INTERRUPTION; OR SUBSTITUTE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO PRACTICE BUILT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12) Indemnification

You agree to indemnify and hold harmless Practice Built, its affiliates, and their officers, directors, employees, and agents from claims, damages, liabilities, and expenses (including attorneys’ fees) arising from: (a) your use of the Service; (b) your User Content; or (c) your violation of these Terms or applicable law.

13) Changes to the Service & Terms

We may modify or discontinue the Service (in whole or in part) and update these Terms at any time. Continued use after changes means you accept the updated Terms.

14) DMCA / IP Complaints

If you believe content on the Service infringes your copyright, send a notice to [email protected] with: (i) your contact information, (ii) identification of the copyrighted work and infringing material, (iii) a statement of good-faith belief, and (iv) your signature. We will respond in accordance with applicable law.

15) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, U.S.A., without regard to conflicts of law. Any dispute shall be resolved by binding arbitration via JAMS in Miami, Florida. Class actions are waived, and disputes must be brought individually. Either party may seek injunctive relief in a court of competent jurisdiction.

16) Termination

You may cancel your subscription to Practice Built at any time by providing 30 days of written notice to [email protected]. Cancellation will become effective at the end of the 30-day notice period, and you remain responsible for all fees incurred up to that date. We may suspend or terminate your access immediately for violations of these Terms, failure to pay, or misuse of the Service. Sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law shall survive termination.
